Trademark registration in India, a step by step guide
Trademark registration in India protects your brand name, logo or tagline by giving you the exclusive right to use it for your goods or services. You file with the Trade Marks Registry using Form TM A, and once filed you can use the TM symbol, with the R symbol coming after registration. Here is the full process, step by step.
Why a trademark matters
A trademark is what stops a competitor from using a name or logo close to yours. It turns your brand into an asset you own, one you can license or sell. Without it, you can build years of goodwill into a name that someone else is free to register first. Filing early is cheaper and far less painful than fighting over a name later.
Step 1, the public search
Before you file, run a public search on the Trade Marks Registry to check whether an identical or similar mark already exists in your class. A clean search reduces the risk of objection and opposition. Skipping this step is the most common reason a filing runs into trouble.
Step 2, choose the right class
Goods and services are divided into 45 classes under the NICE classification. You file in the class or classes that match what you actually sell. For example, software sits in a different class from clothing or food. Choosing the wrong class is a costly mistake, because protection only applies to the classes you register.
Step 3, file Form TM A
You file the application using Form TM A with the Trade Marks Registry. The application includes the mark, the applicant details, the class and the description of goods or services. Once it is filed, you can start using the TM symbol next to your mark, which signals that you have claimed it.
Step 4, examination
A trademark examiner reviews the application and issues an examination report. The report may raise objections, for example if the mark is too similar to an existing one or is considered too generic. You respond to the report, and a hearing may be held if needed.
Step 5, publication and the opposition window
Once it clears examination, the mark is published in the Trade Marks Journal. From publication there is a 4 month opposition window, during which any third party can oppose your mark. If no one opposes it, the application moves toward registration. If someone does, the matter goes through an opposition proceeding.
Step 6, registration
If the mark is unopposed, or you win any opposition, the Registry registers it and issues the registration certificate. Now you can use the R symbol, which marks it as a registered trademark.
The realistic timeline
An unopposed trademark typically takes 12 to 24 months from filing to registration, mostly because of the examination and the 4 month journal stage. The good news is that your protection effectively starts from the filing date, and you can use the TM symbol the whole time. So the long timeline does not leave your brand exposed while you wait.
